Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Efebia Srl (“Efebia,” “we,” “us,” or “our”), governing your use of the Thea mobile application (“Thea,” “the App”) and all related services.

By creating an account or using Thea, you agree to be bound by these Terms. If you do not agree, do not use the App.


2. Eligibility

To use Thea, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement

By using the App, you represent and warrant that you meet these requirements.


3. Account Registration & Security

3.1 Account Creation

You may create an account using your email address and password, or through Google OAuth or Apple Sign-In. You agree to:

  • Provide accurate, complete, and current information
  • Provide your legal name (accurate birth data is essential for the quality of your personalized readings)
  • Maintain only one account per person

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account

You must notify us immediately at info@efebia.com if you become aware of any unauthorized access to or use of your account.


4. Description of Service

4.1 Overview

Thea is an AI-powered application that generates personalized energy and astrological readings based on your birth data and preferences.

4.2 Metaphysical Systems

Thea draws from 10 metaphysical systems to generate your readings:

  1. Akashic Records
  2. Brahma Method Astrology
  3. Chaldean Numerology
  4. Evangeline Adams Business Astrology
  5. Human Design
  6. Pythagorean Numerology
  7. Tesla Numerology
  8. Vedic Astrology
  9. Western Astrology
  10. Synthesis (combined overview)

4.3 Features

  • Readings: Personalized daily, weekly, and monthly readings
  • Deep dives: In-depth analysis on specific topics within your readings
  • AI chat assistant: Conversational interaction for follow-up questions and guidance

4.4 Life Areas

Readings can be tailored to your primary intent across four life areas: health, wealth, relationships, and business.


5. AI-Generated Content Disclaimer

5.1 Nature of Content

All readings, deep dives, chat responses, and other content in Thea are generated by artificial intelligence. This content is provided for entertainment, personal reflection, and informational purposes only.

5.2 Not Professional Advice

Thea’s content does NOT constitute and should not be relied upon as:

  • Medical or health advice
  • Financial or investment advice
  • Legal advice
  • Psychological or therapeutic advice
  • Any other form of professional advice

5.3 No Guarantees

We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. AI outputs may vary between sessions and may contain errors or inconsistencies.

5.4 Professional Consultation

You should always consult qualified professionals for important decisions regarding your health, finances, legal matters, or any other significant life decisions. Never delay seeking professional advice because of something you read in Thea.


6. Subscription Terms

6.1 Plans

Thea offers the following subscription tiers:

Specific pricing is displayed in the App at the time of purchase and may vary by region.

6.2 Billing

All subscriptions are billed through the Apple App Store (iOS) or Google Play Store (Android). Efebia does not process payments directly.

6.3 Payment

Payment is charged to your Apple ID or Google account at the time of purchase confirmation.

6.4 Auto-Renewal

Subscriptions are auto-renewable on a monthly basis. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period.

6.5 Cancellation

You may cancel your subscription at any time through your device’s subscription management settings:

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions

Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. No partial refunds are provided for unused portions of a billing period.

6.6 Price Changes

We may change subscription prices with advance notice. Continued subscription after a price change constitutes acceptance of the new price.

6.7 Free Trials

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends.


7. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Attempt to gain unauthorized access to other users’ accounts or our systems
  • Use automated means (bots, scrapers, crawlers) to access or interact with the App
  • Attempt to use the AI chat to generate harmful, abusive, hateful, or otherwise objectionable content
  • Misrepresent your identity or provide false birth data with the intent to deceive or abuse the service

8. Intellectual Property

8.1 Ownership

The App, including its design, user interface, logos, branding, software, and all associated intellectual property, is owned by or licensed to Efebia.

8.2 Trademarks

“Thea” and the Thea logo are trademarks of Efebia. You may not use these marks without our prior written consent.

8.3 AI-Generated Content

AI-generated readings and content provided to you are for your personal, non-commercial use only. You may not redistribute, publish, sell, or commercially exploit any AI-generated content from Thea.


9. User Content

9.1 Your Content

You retain ownership of content you submit to the App, including chat messages and questions.

9.2 License to Efebia

By submitting content, you grant Efebia a non-exclusive, worldwide, royalty-free license to process, store, and use your content solely for the purpose of delivering and improving the service.

9.3 No Ownership Claim

Efebia does not claim ownership of your submitted content.


10. Privacy

Your use of Thea is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal data.


11. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EFEBIA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY — fitness for a particular use or market
  • FITNESS FOR A PARTICULAR PURPOSE — suitability for your specific needs
  • NON-INFRINGEMENT — freedom from intellectual property claims
  • AVAILABILITY — uninterrupted or error-free operation

We do not guarantee that the App will be available at all times, free from errors, or free from harmful components.


12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

12.1 Liability Cap

Efebia’s total aggregate liability to you for any and all claims arising from or related to the App or these Terms shall not exceed the total amount you paid to Efebia in the 12 months preceding the claim.

12.2 Exclusion of Damages

Efebia shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Service interruptions or downtime
  • Errors or inaccuracies in AI-generated content
  • Decisions made based on AI-generated content
  • Failures of third-party services (including Apple, Google, or AI providers)

12.3 Applicability

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Efebia has been advised of the possibility of such damages.


13. Indemnification

You agree to indemnify, defend, and hold harmless Efebia, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of or inability to use the App
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights

14. Termination

14.1 By Efebia

We may suspend or terminate your account at any time if you violate these Terms, with or without prior notice.

14.2 By You

You may delete your account at any time through Profile > Data Privacy in the App.

14.3 Effect of Termination

Upon termination:

  • Your access to the App and all paid features ceases immediately
  • Your data will be handled in accordance with our Privacy Policy (see the Data Retention & Deletion section)
  • Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive

15. Apple App Store Additional Terms

If you downloaded Thea from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Efebia, not Apple Inc. (“Apple”). Apple is not a party to these Terms.
  • Efebia, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • Apple is not responsible for any claims related to the App, including but not limited to product liability claims, consumer protection claims, or intellectual property infringement claims.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

16. Google Play Additional Terms

If you downloaded Thea from the Google Play Store:

  • Your purchase and use of the App is also subject to the Google Play Terms of Service.
  • Google is not responsible for the App or its content.
  • In the event of any conflict between these Terms and the Google Play Terms of Service regarding the App, these Terms shall prevail to the extent permitted.

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

17.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of the App:

  1. Good-faith negotiation: The parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days.
  2. Jurisdiction: If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts of the courts of Milan, Italy.

17.3 EU Consumer Rights

If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection legislation. You may bring proceedings in your country of residence.

17.4 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr


18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.


19. Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and Efebia regarding your use of Thea, and supersede all prior agreements and understandings.


20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through an in-app notice.

Your continued use of Thea after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
